About the Flash and Smoke nades

Is flash and smoke weapons?
I remember someone got killed because he had a smokenade/flashNade in his hand. And he says its only smoke because it wont hurt the CT's.

Was it right to kill a T with smokenade/flashnade or not ?

I think terrors can only have smoke nades cuz they dont hurt anybody and a weapon is something what can bring damage......But the rules say smoke flash and he are not allowed....

cts have to tell ts to drop it, not instant kill
